General Terms and Conditions (GTC)
1. General
These General Terms and Conditions (GTC) apply to all orders and agreements between the client and 3D Track – Anastasiia Patsenko. By placing an order, the client acknowledges these GTC. Deviating terms and conditions of the client are only valid if expressly confirmed in writing.
2. Commissioning
All orders are valid only to the extent specified in the order confirmation. Changes or additional agreements must be made in writing. Discretion and confidentiality are guaranteed.
3. Data
The client shall provide all documents necessary for the project (plans, models, material specifications, photos, etc.) in suitable digital form in good time before the project begins. Incomplete or incorrect data may lead to deviations in the final result. All 3D data, textures, and renderings created by 3D Track – Anastasiia Patsenko remain the intellectual property of 3D Track – Anastasiia Patsenko.
4. Project Process
The project process includes:
- Provision and approval of basic data (plans, models)
- Creation of preview images and fixation of perspectives
- Integration of materials, lighting, and further details
- Production of the final visualization
- Minor corrections in the final stage
Variants and additional services must be agreed separately.
5. Services
Services include 3D visualizations, animations, and similar representations. The exact description of services is specified in the offer. Special models, furniture, or objects not included in the standard library must be provided by the client or will be charged separately.
6. Third-party Services
3D Track – Anastasiia Patsenko is entitled to subcontract necessary third-party services (e.g., photography, music, voice recordings).
7. Changes
Subsequent change requests that deviate from the approved data must be communicated in writing and will be charged separately.
8. Delivery, Deadlines
Compliance with agreed deadlines requires the client to provide all necessary documents on time. Delays due to late data or approvals are not the responsibility of 3D Track – Anastasiia Patsenko. Complaints must be made in writing within 7 days of delivery.
9. Copyrights, Usage Rights
The copyrights to all renderings and visualizations created remain with 3D Track – Anastasiia Patsenko. The client receives a right of use after full payment. Modifications to the renderings without consent are not permitted.
3D Track – Anastasiia Patsenko is entitled to use the created works for self-promotion unless otherwise agreed in writing.
10. Liability
Liability for damages due to force majeure is excluded. The client indemnifies 3D Track – Anastasiia Patsenko against claims by third parties.
11. Fees, Payment Terms
Invoices are payable immediately without deduction. In the event of default, 3D Track – Anastasiia Patsenko reserves the right to suspend ongoing work. Default interest will be charged at the usual bank rate. The right of use only comes into effect after full payment.
12. Place of Jurisdiction, Place of Fulfillment, Applicable Law
Place of fulfillment and jurisdiction is Wels, Austria. Austrian law applies.
13. Severability Clause
If individual provisions of these GTC are invalid, the validity of the remaining provisions shall remain unaffected.
